Security

As a leading provider of online services, J. J. Keller & Associates, Inc.® is committed to providing many layers of security to preserve the confidentiality of your information. Our server environment is protected by a state of the art "security wall", the site is password protected, and we use data encryption between the web servers and your browser. To ensure you that the CIC has taken the appropriate steps to secure the integrity of your information, the following answers are provided to the most frequently asked questions:

Can someone else access the information I have entered in the CIC?

The best way to secure your information is to protect your user name and password. Without your user name and password, another CIC subscriber cannot gain access to any of your records. We strongly suggest that you change your password on a regular basis and keep it confidential at all times. As described in the Personal License, "You may not allow others to access the CIC using your Personal License Password or User Name"

As an added security precaution, if you are logged into the CIC and your session is idle for two hours, you will be automatically logged out of the CIC and will need to log back in to access the service.

The records you establish in the CIC are stored on servers at a secure, offsite facility. Access to the data on these servers is limited to a small group of authorized Compliance Services staff only. This small group of authorized staff has signed a Non-disclosure (Confidentiality) agreement to protect your data.

How does the CIC protect my information from being lost?

The CIC servers are located in a secure, state-of-the-art Internet hosting facility. The servers are monitored 24 hours a day, seven days a week for any signs of technical problems or malicious activity (including intrusion detection). Backups of all servers are created on a frequent basis to protect your data in the unlikely event of a hardware failure. A stringent schedule of preventative maintenance is followed to minimize this risk. In addition, we maintain a fully functional backup site at another location to protect against data loss in the event of a physical disaster (fire, flood, etc.)

Whenever you proceed to delete information in the CIC, you will be asked to confirm the deletion of that information.

"We use data encryption between the web servers and your browser" - what does this mean?

Secure Sockets Layer (SSL) protects data transferred over http using encryption enabled by the The CIC server's SSL Certificate. An SSL Certificate contains a public key and a private key. A public key is used to encrypt information and a private key is used to decipher it. When your browser points to the CIC (a secured domain), SSL authenticates the server (the CIC) and the client (your browser) and establishes an encryption method and a unique session key. This begins a secure session that guarantees message privacy and message integrity.

The CIC uses 128-bit SSL encryption. This is the level used by most banks and other sites where a secure environment is necessary.

Why does the CIC use Secure Sockets Layer (SSL) encryption?

Using SSL allows us to add even greater security to all of your data on the CIC. The small lock seen in the lower portion of your web browser (Internet Explorer and Firefox Only) indicates that the page you're visiting is completely secure. You may be presented with a "Security Alert" popup window indicating that you are entering a secure site. This message can be enabled or disabled within your browser settings, if you choose.

What does it mean to be thawte™ secured?

The CIC has obtained SSL certificates through a company called thawte™, a proven industry leader and trusted source for digital web server certificates. A thawte™ SSL certificate ensures that all information you send to us via the internet will be encrypted.

Virus Protection

Our virus scanning software is updated on a daily basis to ensure that we have the highest protection available. All site traffic is scanned as it enters or leaves the site.

Independent Security Audits

The CIC uses IBM and other 3rd party organizations to conduct periodic audits of our security procedures and systems. The audits provide an additional check of our systems to ensure that system security is maintained at the highest level.

J. J. Keller maintains the Site in order to provide subscribers of our Managed Services (Services) with convenient access to information and documents pertaining to the Services. Access to the Site is only granted to authorized employees or agents of organizations who have entered into a related Services Agreement with J. J. Keller (Clients). J. J. Keller will establish unique accounts and passwords for each authorized user of our contracted Clients. Access to specific functions and content will be configured on a user-by-user basis by either J. J. Keller or a Client authority based on mutually-agreeable criteria. Your access to and use of this Site is subject exclusively to these Terms and Conditions.

You are responsible for maintaining the confidentiality of your account username and password and for any and all activities that occur under your password or account. You agree not to impersonate any person or entity or falsely state or otherwise misrepresent your identity or affiliation with a person or entity. You agree to immediately notify J. J. Keller of any unauthorized use of an account, password or any other breach of security known to you. You agree that J. J. Keller may terminate your password, account, or use of the Site at J. J. Keller’s sole discretion for any reason.

The information and materials contained in the Site may only be used for legitimate business purposes related to the Services. Your right to use the Site is personal to you/your company. You agree not to reproduce, duplicate, copy, sell, resell, use or exploit for any commercial purposes, the Site or use of or access to the Site or any J. J. Keller information or technology obtained from the Site.

As a condition of your use of the Site, you warrant to J. J. Keller that you will not use the Site for any purpose that is unlawful or prohibited by these Terms and Conditions. You agree to abide by all applicable local, state, national, and international laws and regulations in your use of the Site. You may not use the Site in any manner which could damage, disable, overburden, or impair the Site or interfere with any other party’s use and enjoyment of the Site. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site.

You agree to defend, indemnify and hold J.J. Keller harmless from any and all claims, damages, costs, and expenses, including attorney’s fees arising from and related to your use of the Site and any unauthorized use of an account or password,

J. J. Keller reserves the right to modify or discontinue, temporarily or permanently, the Site for any reason, at its sole discretion, with or without notice to you.

Information Security

J. J. Keller is committed to protecting the documents and information we manage for our clients (“Client Records”). Client Records are regarded as confidential and protected in accordance with our information security policies. J. J. Keller takes reasonable steps to maintain physical, environmental, technical and procedural safeguards to prevent confidential information from being accessed by unauthorized individuals. You are not permitted to access any functions or information that are not expressly authorized. You are responsible for treating all Site content (including information obtained from the Site) as confidential and protecting the information available within the Site in accordance with all applicable laws, including data privacy and security laws.

Ownership

Excluding only Client Records, all tangible and intangible components of the Site, including without limitation, products, informational text, software code, images, photographs, illustrations, artwork and other graphical materials, names logos, trademarks and service marks and audio, are the property of J. J. Keller or are licensed to J. J. Keller. J. J. Keller and its licensors retain all proprietary rights, including copyright.

Guidelines for Use of the Content

Internal Use. Your may use DataSense content – forms, certificates, guidance documents - within your organization as outlined in this section. You may not, and may not permit others to, use DataSense content to prepare work, documents or reports, etc., for any party outside of your organization.

Work Personally Authored. Your may incorporate DataSense content into work you personally author, but the new work may only be used internally. The new work may be posted on your intranet.

Intranet Use. You may not download DataSense content and post it on your intranet.

Infringe. You may not use DataSense in any manner that infringes the intellectual property or other rights of another party.

Disassemble. You may not disassemble, decompile or otherwise derive source code from DataSense.

Termination

Access to the Site is dependent on your need to know and continued employment with your employer. Your access to Site shall terminate effective immediately upon either termination of employment or a change in duties rendering your need for access unnecessary.

Report Unauthorized Use or Copying

Unauthorized copying of software and internet content is theft. Contact us to report pirated content and software.

Disclaimer/Limitation of Liability

J. J. Keller shall not be held liable for any improper or incorrect use of the materials or information described and/or contained in this Site or in its products, and assumes no responsibility for any user’s use of them. IN NO EVENT SHALL J. J. You may not use our Site or export any material in violation of U.S. export laws and regulations. If you access our Site from a location outside of the United States, you are responsible for compliance with all local laws.
